NSS BOG E-Vote - Schoharie Cave Nature Preserve

As President I have been requested to conduct an official email ballot according to the guidelines established in Act 06-183 Mail Ballots 4-7-01, 8-24-68, 11-16-68 after four members of the Board requested this action, namely Tiderman, Bush, Kayes, and Liebman. To be adopted, this Motion by email requires a two-thirds affirmative vote of the entire Board of Governors. The text of any matter that was the subject of a mail ballot, with the vote of each member, will be read into the minutes of the subsequent meeting. Notice of this proposed action will be posted to the Society web site not later than the day following the transmission of the call for the vote.

Keeler moves: Up to $2000 is authorized from the Fund for Litigation for legal representation for the Schoharie Cave Nature Preserve. Christa Hay, is the focal person concerning the issue.

Background Info:

There is an issue being addressed with the Schoharie Cave Nature Preserve. The new owners of an adjacent property would like to build a new house, barn and septic system, and are trying to figure out an adjoining landowners responsibilities and duties to the caves and NSS and what may be considered damaging, destroying and less making the property usable. The NSS was contacted by the new owners since there is a clause in their deed about the cave.

Christa Hay, the Schoharie preserve manager has requested legal representation for a New York lawyer to represent the NSS for a meeting addressing "cave rights". The meeting is June 17th, this Thursday. Christa et. al. have contacted a competent lawyer to provide a "cave rights" interpretation of the New York laws. Ray Keeler, the Administrative VP, has an email motion to the BOG that is being voted on now. The motion authorizes up to $2000 from the Fund for Litigation to Protect Caves for interpretation of the existing laws.

Voting began on 6/14/2010.

Keeler withdrew his motion.

Per Ray: The motion was withdrawn as the "pressing need" for a legal opinion had passed, and it would be better to get current information from the Preserve manager at the Convention, before deciding to proceed.
